These terms are the agreement between you and UNSEEN FORMS LIMITED when you use Spelling Garden at spelling.garden. By using it you accept them.

What Spelling Garden is

A spaced-repetition spelling app for adults. It finds the words you personally get wrong, plants them in a garden, and brings each one back for review at the moment you are about to forget it.

It is a practice tool, not a course, not a qualification, and not a substitute for teaching. We do not promise any particular improvement in your spelling.

The free garden

You can use Spelling Garden without paying and without an account. A free garden holds 20 plants. You keep every one of them, you keep reviewing them for as long as you like, and you can remove a plant to make room for another.

What a free garden cannot do is grow past 20 plants.

An unclaimed garden lives in one browser

Until you subscribe, your garden is identified by a token stored in your browser. This matters and we would rather say it plainly than bury it: if you clear your browser data, an unclaimed garden is permanently lost and we cannot get it back. There is no account to recover it from, because you have not made one.

Paying

Paying removes the 20-plant limit: each garden you fill opens another. It lets you practise your words again once the day's watering is done, as often as you like; that extra practice is optional and never changes when a word is next due. It also gives your garden a real account, reached from any device by asking for a sign-in link. There are two ways to pay.

• A monthly subscription. It renews automatically each month until you cancel.
• A one-time payment. You pay once and keep everything a subscription gives you for as long as Spelling Garden is running. It is not a subscription: nothing renews and there is nothing to cancel.

Prices are shown to you before you buy and include any tax due in your country. Payment is taken by Stripe.

The price you sign up at is the price you keep

If we raise our prices, your subscription stays at the price you started on for as long as you remain subscribed. We will not increase what you pay under an existing subscription. A one-time payment is never asked for again.

Cancelling

You can cancel at any time from Account in the menu, which takes you to Stripe's billing page. There is no notice period and nothing to email us about. When you cancel you keep everything you have paid for until the end of the period you have already paid, and you are not charged again.

What happens when a subscription ends

This is the part people worry about, so it is worth being exact.

• You keep every garden and every plant. Nothing you grew is hidden, locked or deleted.
• You carry on reviewing all of them. Every word still comes back on schedule, however many you have.
• You stop collecting new words once you are above the free 20, until you subscribe again.
• Extra practice stops. The daily watering carries on as normal; practising again after it is what a subscription adds.

Resubscribing puts everything back exactly as it was.

Refunds and your cancellation rights

Our promise: if you ask within 14 days of a payment, we will refund it in full, with no questions. Write to hello@spelling.garden.

Separately, consumers in the UK and EU have a statutory right to cancel a distance contract within 14 days. Because this is digital content supplied immediately, that right can normally be lost once supply begins. Our own 14-day refund above is offered regardless, so you are not worse off either way, and nothing here removes any right you have by law.

Using it properly

Please do not: try to break into other people's gardens or our systems, take the word corpus, the sentences or the recorded audio for use elsewhere, run automated clients against the service, or resell access.

Anything you write yourself, such as a memory hook for a word, stays yours. By writing it here you allow us to store and display it back to you.

Everything else in Spelling Garden, including the artwork, the sentences, the recorded audio and the software, belongs to us.

Your account and its security

Signing in is by a one-time link sent to your email address. Anyone who can read that inbox can reach your garden, so keep it secure. Tell us straight away if you think somebody else has access.

You must be at least 16 to have an account.

Availability

We aim to keep Spelling Garden running and correct, but it is provided as it is. We do not promise that it will always be available, uninterrupted, or free of mistakes, and we may change or discontinue features.

If we discontinue the service entirely we will give reasonable notice, and refund subscribers any period paid for and not yet used. A one-time payment buys access for as long as the service runs, so it is not refunded when the service closes, beyond the 14-day promise above.

Our liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights as a consumer are unaffected.

Beyond that, and because this is a small consumer subscription, our total liability to you is limited to the amount you have paid us in the 12 months before the claim. We are not liable for indirect or consequential loss.

Changes to these terms

We may update these terms. The date at the top says when they last changed. If a change materially affects subscribers we will tell them by email before it takes effect, and continuing to use the service afterwards means accepting it.

Law

These terms are governed by the law of England and Wales, and disputes go to the courts of England and Wales. If you are a consumer living elsewhere in the UK or in the EU, you keep the protection of your own country's mandatory consumer law and may bring proceedings there.
